The Final Movember Update !

30 days on and it's nearly all over! So far the Ro No Mo Bros have raised £792 in online donations and £90 in cash/cheques and in most cases not exactly looked our best for the past month! (see attached photos!)

R&N Breakfast Club

We are delighted that we will be able to host a further Breakfast at the Theatre Royal before Christmas and even more so that Peter Wilson MBE DL and Chief Executive at the Theatre has agreed to talk to us once again.

The Breakfast will be on Tuesday 4th December at 7.45am for 8.00am and we anticipate lots of interest in attending, given the speaker and the excellent breakfasts that the Theatre produce!

Movember!

"Movember" is upon us and Rogers & Norton are delighted to announce our support for what is a very worthy cause.

For those of you who are not aware the idea behind Movember is for those taking part (known as 'Mo Bros') to grow moustaches for the 30 days of November to raise cash for and awareness of mens cancer charities and specifically Prostate and Testicular cancers. Successes for Rogers and Norton Litigation Team

Rogers & Norton's litigation team is delighted to report two recent successes on claims involving HM Revenue and Customs and the Border Agency.

The team, led by Peter Hastings, acted for a company who had been served with an assessment for alleged excise duty for a sum in excess of £200,000. On review, and after a detailed submission on matters of European law and UK law and the Excise Goods (Holding, Movement and Duty Point) Regulations 2010, the assessment was withdrawn, much to the delight of the Firm's client.

The team also acted for an International Company who imported silver granules into the UK which were detained but released after representations made by the team, including the failure of HMRC and the Border Agency to provide sufficient grounds to justify detention.

Peter commented "In both cases, substantial sums were involved and there could have been serious consequences for these businesses if we had not acted quickly and successfully.  Our work in connection with HMRC has expanded considerably and with great success".

The team is currently acting on numerous other cases involving HMRC and the Border Agency including a seizure of gold, advising on misfeasance claims and insolvency related matters. It represents clients locally, throughout the UK and Internationally and also appears in the Tax Tribunal and conducts Judicial Review proceedings in addition to Appeals and Condemnation Proceedings.

Charity Golf Day in aid of MacMillan Nurses

We held our annual Charity Golf Day on Friday 14th September 2012 at Bawburgh in aid of MacMillan Nurses and we hope to have raised a significant sum of money for this very worthy charity, which we have now supported for 14 years.
We did arrange for Richard Aldridge to take photographs on the course and he has ended up taking over 500! There are far too many to view here but if you click here you can see a large selection of them in all their glory!  The “Beat the Pro” Competition seemed to be received very well too and we are grateful to Mark Spooner at Bawburgh for helping us out with this. We are told he is an excellent teacher of golf if anyone wishes to book any lessons with him.

We really appreciate the support that we receive for this event from local business and individuals alike and we understand that financially it is impossible to support every worthy event and we feel very privileged that our clients and contacts choose to help MacMillan Nurses by attending our Golf Day.
We did have three auction prizes on the day and have sold two of them but we do still have a Norwich City signed shirt by this season’s squad to dispose of with a reserve price of £100.00. If you would be interested in making an offer for this item please let me know and we will accept the highest bid received before a deadline date of Monday 8th October 2012. This would make a great Xmas present with all the proceeds going to Macmillan too!

Rogers & Norton Highly Praised in the Legal 500 Rankings

Rogers & Norton have once again been highly ranked amongst East Anglia’s Law Firms in the Legal 500 UK 2012 rankings. The firm’s departments have been recognised for the quality of advice and service provided to their clients across the practice.

The year has seen improvements in the rankings for departments and a wealth of positive comments.

Corporate Commercial and Dispute Resolution

Rogers & Norton Charity Golf Day

The 14th Annual Rogers & Norton Charity Golf Day in aid of MacMillan Nurses World's Biggest Coffee Morning will be held at Bawburgh Golf Club on Friday 14th September 2012. Entries have been good so far with 21 teams playing on the day although we do have vacancies for even more teams to take part and support this very worthy Charity and the excellent work that they do every day.

The entry fee for a team of four people is £220 which includes bacon roll and coffee on arrival, 18 holes of golf followed by a 3 course meal in the evening with prizegiving and there are some lovely prizes to be won. The added bonus of taking part is the opportunity to play for the Rogers & Norton Team and Individual trophies too!

We usually have a raffle too and in addition this year an auction of 3 items including a Norwich City FC shirt signed by this season's squad. There are various team and individual competitions taking place on the day as well as the usual nearest the pins and longest drive tests. Mark Spooner, the Professional at Bawburgh, has also kindly agreed to take on allcomers at the 4th hole for a "Beat the Pro" competition for an entry fee of a fiver with all proceeds going to the Charity and we are very grateful to him for his help.

The main emphasis for the event is however to enjoy the day and meet old and new friends whilst helping us to fundraise at the same time and Ian and his staff at Bawburgh are excellent at helping us achieve this.

We do have limited sponsorship opportunities on the day too if you are interested by placing banners on all 18 holes for a modest cost of £50 (except premium holes 1 and 18 which are £100) or sponsoring the nearest the pins and longest drive for the same fee and all proceeds from this go directly to MacMillan Nurses too. R&N assists LSI Architects with new venture

As has been reported recently, LSI Architects have expanded their services into Qatar.  Rogers and Norton were delighted to assist LSI Architects with their legal requirements for their exciting expansion and construction works in Qatar.

Peter adds "In recent months, we have seen an increase in international work for our commercial and litigation teams, receiving instructions from clients based in Dubai, the Caribbean and throughout Europe.

In particular, we have recieved instructions to act on a multi-million pound Arbitation, which is proceeding through the International Court of Arbitration and disputes with HMRC (Customs and Excise) and the Border Agency."

BBQ

The Annual Rogers & Norton BBQ was held in the grounds of the office on the evening of Tuesday 17th July and despite real fears that the heavens would open upon us as had been the case the previous day, we were blessed with a warm sunny evening. 
A marquee had been erected to give shelter on the evening if necessary but this was fortunately not required.  Over 250 guests attended enjoying excellent food, wine and real ale and most took the opportunity to catch up with friends in a very relaxed atmosphere. 
The BBQ is held as an annual event to thank our contacts and clients for their support throughout the year and has become one of the summer social events to attend it seems!

R&N Ball a great success!

The Rogers & Norton 30th Anniversary Charity Ball took place on Saturday 2nd June at Colney Hall and we are delighted to say it was a great success! 

Thank you to all our guests and sponsors for your support and for celebrating with us our 30th Anniversary. The evening was one of the most successful Rogers & Norton balls in our history and you all helped make the night unforgettable.

With the help of over 400 guests we have raised approximately £10,000 to support our chosen charity Nelsons Journey and this figure continues to grow as we collect in further contributions arising from the Ball.

We will have some photographs and highlights from the night on our blog soon so keep checking for updates! We will also confirm the total amount raised for charity in due course.

It has been reported in the Claims Magazine today that Donns, a Claimant firm of solicitors in Manchester has gone into administration.

It appears that many clients will now be contacted by Irwin Mitchell and be invited to transfer their file to this alternative firm. Long battle ends in success

A 5 year fight is over following a decision by the UK’s highest Court which now means that employers’ insurers will be obliged to pay compensation claims of those suffering from or the families of those who have died from mesothelioma, a disease that can lay undetected for many years. It means that many thousands of people will at long last be entitled to compensation following the landmark ruling that the liability of insurers arises at the date of exposure to asbestos and not when symptoms of mesothelioma are detected which may be decades later.

Yesterday the Supreme Court delivered a long awaited landmark Judgment in what has been termed the mesothelioma “trigger litigation” which has seen a long running Court battle at an end, the Supreme Court having now ruled that the relevant date for the purposes of entitlement to compensation is the date of exposure and not the date when symptoms may develop or manifest themselves which can be many years later.

This particular issue related to the stance taken by a number of insurers that they were not obliged to pay out on such claims and that the key date for claiming arose at the date that the disease developed. This ruling has ended that argument in confirming that the relevant date is the date of employment during which the exposure occurred.

This will be of some comfort to those who have contracted mesothelioma, an insidious cancer, as well as their loved ones who will be able to pursue claims against the insurers as a result of their exposure to asbestos resulting in them contracting the disease.

For those who are suffering such condition and those who have lost their personal battle but whose families continue to pursue for their just entitlements, this decision brings to an end a whole host of test cases which have challenged the entitlement of those exposed to asbestos being able to recover compensation.

These cases are particularly difficult and raise a variety of complex legal issues. Expertise as well as compassion and the ability to empathise are key elements in ensuring that those who are entitled to compensation secure that compensation.

Rogers & Norton's Personal Injury Department has dealt with a number of significant asbestos cases and to achieve a successful outcome requires stubborn determination and frequently detailed forensic investigation in respect of a client’s employment history. This calls for professionalism, determination and compassion in equal measure.

Into The Dragon's Den


Mark Hambling partner and personal injury expert at Rogers & Norton swapped his usual role of fighting for justice for personal injury victims to become a dragon in the Brundall School Dragons Den. Joining other local business leaders from Oriental Rugs Norwich, Pymm & Co, Bugdens and Norwich City Football Club, Mark heard seven pitches from business formed by groups of year 6 pupils at Brundall School.

The pitches for investment came from potential businesses ranging from a milkshake and Brownie company, a school fitness DVD and a loyalty scheme encouraging children to eat fruit. Each business obtained investment ranging between £20 and £50 and each dragon will now support the children as they strive to develop their business and make a profit to enable interest to be paid back to the investor.

Mark Hambling, Personal Injury partner, has invested in a fitness DVD company which plans to produce a DVD filmed in the school, using the school pupils to be sold in the summer term in the run up to the Olympics. Commenting on the event Mark said, "Whilst I know little about fitness DVD's, as a parent I know how good it is to see your children on screen or in the press. I therefore hope my teams DVD will certainly sell well to the parents in the Brundall and surrounding area".

The pupils worked very hard in preparing for the event and as part of their studies had prepared business plans, marketing strategies and projections. Their presentation of their business proposals to the Dragons was excellent and they engaged in debate and negotiation with the Dragons in a very professional and measured way. Mark commented " I was very impressed with the pupils enthusiasm and skills and had a thoroughly enjoyable afternoon with a group of very able children".

Rogers & Norton were delighted to be one of the supporters of this event and we hope to see some entrepreneurs develop in the future from these year 6 pupils.

Nancy and others


The High Court has recently thrown out a libel claim brought by Nancy Dell’Olio against the Daily Mail. A double page spread under the catchy heading “Return of the Man Eater” referred to her relationship with Sir Trevor Nunn.

In any libel claim the Claimant has to specify the allegedly defamatory meaning contained in the words used.  The Claimant’s first attempt was that they meant she is “a serial gold digger and has deliberately set out to snare herself a wealthy man by making their adulterous affair public thereby destroying his marriage for her own personal gain”.   Since the article had itself pointed out that Sir Trevor Nunn’s marriage had already broken down and that it was him pursuing her, not the other way around, that alleged meaning was abandoned in favour of “a serial gold digger who cynically seeks out relationships with men not for genuine emotional reasons but because they are millionaires and therefore capable of funding her conspicuously lavish and ostentatious lifestyle”.

A libel claim can only go forward for decision by a jury if the judge holds that the article was at least “capable of substantially affecting (or tending to affect) in an adverse manner the attitude of other people towards this Claimant”. The article must be read in a reasonable, not strained, way, and read as a whole – not just the headline and not cherry picking out of context.  It is not enough to say that by some person or another the words might be understood in a defamatory way.  The judge has to borrow the mindset of the hypothetical reasonable reader who is taken be representative of all likely readers of the publication.

I always smile at the Court’s approach to this notional being. He is “not naïve but he is not unduly suspicious. He can read between the lines. He can read an implication more readily than a lawyer and may indulge in a certain amount of loose thinking but he must be treated as a man who is not avid for scandal and someone who does not, and should not, select one bad meaning where other non-defamatory meanings are available”.

The Court’s Decision

The Judge found the article “unflattering and even insulting”- but held that the references to lifestyle, money and wealth did not pass “the threshold of seriousness required if a publication is to be capable of being defamatory”. The article was simply not capable of bearing any defamatory meaning, and there was no further decision to be made on this at a full jury trial.

Comment

The case is a useful insight into the judicial approach to the world of celebrity spats, and the workings of the filters built into the litigation process. Not every aggrieved celebrity is always entitled to take her case all the way to a costly trial. Both the defendant (even the Daily Mail) and the public purse need protection from the continued pursuit of litigation which is doomed to fail.

Crime will not pay

CICA Scheme is to be overhauled. Criminals will only be able to claim compensation for being victims of crime in "exceptional circumstances", under proposals by the justice secretary, Mr Ken Clarke. This if after the annual costs of the taxpayer funded scheme trebled to nearly £300m since 1997.

The proposed reforms include:
  1. Criminals to contribute more towards the scheme. Payment of "victim surcharges" by more offenders, and higher fines for driving offences, will it is hoped raise £50m for victims.
  2. To stop criminals claiming for injuries and psychological damage.
  3. Claims for minor injuries under the scheme for people in England, Wales and Scotland would also be restricted under the plans.
  4. A person with a criminal record will only be able to claim compensation in exceptional circumstances. This could include, for example, a minor offender who is very seriously injured or a criminal who prevents someone else being attacked.
Over the past decade, 20,000 people with criminal records have been paid more than £75m, including a rapist and a person convicted of two killings.

We are delighted to announce our 30th Birthday Celebration on Saturday 2nd June 2012 exactly 30 years to the day from when we first opened our doors.

Our 30th Birthday Ball will be held in a grand traditional Marquee at the stunning location of Colney Hall, Norwich.

This promises to be one of the most lavish events Norwich has ever seen.

The design & decor will be spectacular and Brasteds have been employed to create, prepare and serve an exquisite 4 course dinner.
